Are you compliant with US federal and state privacy laws?
Yes - if you have an opt-in and/or opt-out cookie banner you can treat us similarly to any other pixel, cookies, and other tracking technology. These transparency requirements are no different for Checkmate Enrichment than similar disclosures for Google, Meta, or other third party advertising services.

Transparency: The publishing website that enables the Checkmate pixel tag to operate is responsible for including in its privacy policy information about the use of third party data and/or pixel tags, cookies and other tracking technologies. In many U.S. states, the use of third party advertising (or ‘cross-contextual behavioral advertising’) technologies is considered a ‘sale’ or ‘share’ of personal information, and has specific transparency requirements to disclose the prevalence of such technologies.

Pixel Tag Choice: As many U.S. states consider third party advertising pixel tags a ‘sale’ or ‘share’, merchants and website publishers utilizing these technologies must enable visitors a choice to opt-out of these technologies in order to comply with select U.S. state laws. This is commonly provided by websites through a consent management platform (a.k.a. ‘cookie banner’). While there are no prescriptive requirements in U.S. law how such choices are enabled, California requires that websites include a ‘Your Privacy Choices’ (or ‘Do Not Sell or Share My Personal Information’) link in the website footer (and privacy policy reference).
Are you compliant with email marketing laws?
Yes, all of our emails include an opt-out option to comply with federal requirements. Under U.S. law, prior opt-in is not required for sending marketing communications, as long as recipients are given a clear opportunity to unsubscribe.
In 2003, the U.S. passed the ‘CAN-SPAM Act’ which regulates email marketing, and pre-empts all other U.S. state laws that would require additional requirements for email marketers. The CAN-SPAM Act does not require consent for email marketing, but rather requires accuracy and transparency in commercial communications, notably;

Checkmate as the ‘Sender’ of the message: By default, Checkmate is in the ‘From’ address, clearly identifying it as the ‘Sender’ of the commercial message. In some cases, a merchant may also choose to be included in the ‘From’ address which converts into a dual sender message.

Accurate ‘Subject Line’ and commercial body copy: Checkmate ensures that each email subject line clearly reflects the commercial nature of the message, and includes its own brand reference in addition to the merchants in the header of the message.

Clear and simple opt-out choices: Checkmate’s unsubscribe option is presented in both the header and footer of the initial message, and includes a simple one-click choice. In addition, the law allows for multiple ‘senders’ and unsubscribe choices within a message. For example, if Checkmate and a merchant are both in the ‘From’ address, and the entire message is ‘sponsored’ by a single merchant, then the email footer can include unsubscribe options for both Checkmate and the merchant.
Do you reach out to unsubscribed customers via email?
Checkmate can synchronize with any Merchant CRM system to ensure that email ads do not reach existing unsubscribed recipients.
Is data regularly deleted in case a customer requests it?
Checkmate provides a public email address, privacy@joincheckmate.com, for anyone to opt-out of the use of their email address for Checkmate network email offers. In addition, Checkmate regularly synchronizes with its third party data sources to delete and/or opt-out any individuals who have requested it from those third parties.

We partner with a range of discount platforms and providers, offering our backend technology through white-labeled integrations. Due to strict NDAs, we’re unable to disclose specific partners. These collaborations expand our reach and serve as key distribution channels for Checkmate.
Why do I need to send over my CRM/Klaviyo API keys?
We need this to feed back information on customer journeys back into your CRM to ensure incrementality. These will be shown as events.
